2. Information We Collect
2.1 Information You Provide to Us

2.2 Information Collected Automatically

3. Tracking Technologies, Session Recording, and Communications Monitoring
This section describes technologies that may capture, record, or replay your interactions with the Site and our customer service channels.

We and our service providers use cookies, pixels, tags, web beacons, local storage, and similar technologies to:

We use session replay and behavioral analytics tools that record your interactions with the Site, including mouse movements, clicks, scrolls, taps, keystrokes in non-sensitive fields, and pages viewed. These recordings help us diagnose technical issues, improve user experience, and understand how visitors use our Site.
The providers we currently use for these purposes include:

Microsoft Clarity: behavioral analytics and session replay.

Shopify analytics: platform-native analytics and customer behavior measurement.

Hotjar or FullStory (where deployed): heatmaps and session replay.
Sensitive form fields (such as payment details and passwords) are masked from recording. By using the Site, you consent to the recording of your interactions as described in this Section.
3.3 Advertising and Marketing Pixels
We use advertising pixels and tags to measure campaign performance and serve targeted advertising, including:

These tools may share limited Personal Information (such as hashed email addresses, device identifiers, and browsing activity) with the advertising platforms. This activity may constitute "sale" or "sharing" of Personal Information under certain state laws. See Section 6.
3.4 Customer Service and Communications Platforms
We use Kustomer, an omnichannel customer service platform owned by Meta Platforms, Inc., to manage customer communications across email, live chat, SMS, social media, and voice. Kustomer and similar platforms we may use (including Klaviyo, Postscript, and Attentive for marketing communications) may record, store, transcribe, and analyze the content of your communications with us.
We may also record inbound and outbound phone calls for quality assurance, training, and recordkeeping. A notice is provided at the start of recorded calls.
3.5 Notice of Consent to Recording
By accessing or using the Services, initiating a chat, calling our customer service line, sending a text message to a number associated with Ozarké, or otherwise communicating with us, you acknowledge and consent to the recording, monitoring, storage, and analysis of such interactions by us and our service providers.
If you are a resident of a state that requires two-party consent for the recording of communications (including Florida, California, Connecticut, Illinois, Maryland, Massachusetts, Michigan, Montana, Nevada, New Hampshire, Oregon, Pennsylvania, Vermont, and Washington), you acknowledge and expressly consent to this recording. If you do not consent, do not use the Services and do not communicate with us through recorded channels.
3.6 Do Not Track and Global Privacy Control
Our Site does not respond to Do Not Track browser signals because no common industry standard governs them. However, we do honor Global Privacy Control (GPC) signals as an opt-out of "sale" and "sharing" of Personal Information for residents of states where required by law.

We use Personal Information to:

5. How We Share Personal Information
We share Personal Information with:

Service providers and processors: including Shopify (e-commerce platform and payments), Klaviyo (email and SMS marketing), Postscript and Attentive (SMS), Kustomer (customer service), Microsoft (Clarity analytics), shipping carriers, warehouse and fulfillment providers, fraud screening services, and review platforms.

Advertising partners: Meta, Google, TikTok, Pinterest, and similar platforms for targeted advertising and measurement. This sharing may constitute "sale" or "sharing" under state privacy laws.

Authorities and in legal proceedings: if required by law, subpoena, court order, or to protect our rights, property, or safety, or that of others.

6. Sale and Sharing of Personal Information
Certain state privacy laws (including in California, Colorado, Connecticut, Virginia, Utah, Texas, Florida, Oregon, and Montana) define "sale" and "sharing" broadly enough to include the transfer of Personal Information to advertising partners through cookies, pixels, and similar technologies for cross-context behavioral advertising.
Under these definitions, Ozarké does "sell" and "share" the following categories of Personal Information:

7. Your Privacy Choices and Rights
7.1 Opt Out of Sale and Sharing
You may opt out of the sale and sharing of your Personal Information by:

7.4 State-Specific Rights

These rights apply to residents of California (CCPA/CPRA), Virginia (VCDPA), Colorado (CPA), Connecticut (CTDPA), Utah (UCPA), Texas (TDPSA), Florida (FDBR, where applicable), Oregon (OCPA), Montana (MCDPA), Iowa, Delaware, New Hampshire, New Jersey, Maryland, Minnesota, Tennessee, Rhode Island, Indiana, and Kentucky, subject to each state's specific thresholds and exceptions.
7.5 Texas Residents (TDPSA)
If you are a Texas resident, you have the rights described in Section 7.4. You may exercise those rights using the methods in Section 8. If we deny your request, you may appeal by replying to our response. If your appeal is denied, you may contact the Texas Attorney General at https://www.texasattorneygeneral.gov.
7.6 California Residents (CCPA/CPRA)
If you are a California resident, you have the rights described in Section 7.4. The categories of Personal Information we have collected, sources, business purposes, and categories of recipients are set out in Sections 2, 4, and 5. We have collected all categories listed in Section 2 in the preceding 12 months. We may use authorized agents to submit requests on your behalf; the agent must provide written authorization and we may require you to verify your identity.
Under California Civil Code Section 1798.83 ("Shine the Light"), California residents may request information about disclosures of Personal Information to third parties for direct marketing purposes. To submit a request, contact us at privacy@ozarke.com.
7.7 Nevada Residents
Nevada residents may opt out of the sale of certain covered information by contacting us at privacy@ozarke.com.
7.8 EU, UK, and EEA Residents
Where GDPR or UK GDPR applies, our lawful bases for processing include:

We transfer Personal Information to the United States and other countries that may not provide equivalent protection. Where required, we rely on Standard Contractual Clauses and other approved transfer mechanisms.
8. How to Submit a Privacy Request
To submit a privacy rights request, you may:

We will verify your identity using information we have on file. If we cannot verify you, we may request additional information or deny the request.
We will respond within the timeframe required by applicable law (generally 45 days, extendable once by an additional 45 days where permitted). If we deny your request, you may appeal by replying to our response within 30 days.
Authorized agents may submit requests on your behalf with proof of written authorization. For deletion or sensitive requests, we may require direct confirmation from you.
9. Retention
We retain Personal Information for as long as needed to fulfill the purposes described in this Policy, unless a longer period is required or permitted by law. Typical retention periods are:

Order and transaction records: 7 years, for tax, accounting, warranty, and dispute resolution.

Customer service communications: 3 years from last interaction.

Marketing engagement data: until you unsubscribe or 3 years from your last engagement, whichever is earlier.

Account information: for the life of your account plus 3 years of inactivity, unless you request deletion sooner.

When we no longer need Personal Information, we delete, anonymize, or aggregate it.
10. Children's Privacy
The Services are not directed to children under the age of 13, and we do not knowingly collect Personal Information from children under 13. If we learn we have collected Personal Information from a child under 13, we will delete it. If you believe a child has provided us with Personal Information, please contact us at privacy@ozarke.com.
Purchases on the Site are restricted to individuals 18 years of age or older. We do not knowingly sell or share Personal Information of consumers under 16 without affirmative authorization as required by California law.
11. Rewards Program and Financial Incentives
Our Rewards program and promotional offers (including price differences for account holders, referral bonuses, and loyalty discounts) may be considered "financial incentives" under certain state privacy laws. By enrolling in the Rewards program, you consent to the collection and use of the Personal Information described in this Policy for the purpose of administering the program. You may withdraw from the program at any time by contacting privacy@ozarke.com, and doing so will not result in different treatment outside the program.
The value of the incentive is reasonably related to the value of your Personal Information to our business, as calculated based on expected program participation, average order value, and associated marketing costs.
12. Security
We use administrative, technical, and physical safeguards designed to protect Personal Information, including encryption in transit, restricted access, and monitoring for unauthorized access. No method of transmission or storage is fully secure, and we cannot guarantee absolute security.
If we become aware of a security incident affecting your Personal Information, we will notify you and relevant authorities as required by applicable law.
13. Third-Party Links and Services
The Services may contain links to third-party websites, services, and tools that we do not control. This Policy does not apply to those third parties. We encourage you to review the privacy policies of any third-party services you use.
14. Changes to This Policy
We may update this Policy from time to time. The "Last Updated" date at the top reflects the most recent revision. If we make material changes, we will notify you by posting a notice on the Site, by email, or by other means as required by law. Your continued use of the Services after the effective date of an updated Policy constitutes acceptance of the revised Policy.
